ER-BAL FOOD LTD. MEMBERSHIP AGREEMENT AND TERMS OF USE

By using, registering as a member, and placing orders on this shopping site, all customers are deemed to have accepted the applicable rules and regulations in advance.

You ('User' / 'Member') irrevocably accept, declare, and undertake that by using all services offered on the site, you are subject to the terms of this Membership Agreement, and by using the service on the site and initiating your membership, you have the legal capacity to enter into a contract according to the legislation you are subject to, that you are over 18 years of age, and that you have read, understood, and will be bound by the rules of this Membership Agreement.

This Membership Agreement is perpetual and imposes rights and obligations on the parties regarding site usage and account transactions. The parties declare that they will fully comply with the aforementioned obligations under this approved Membership Agreement.

1. RESPONSIBILITIES AND WEBSITE USAGE RULES

1.1. The company reserves the right, within the scope of this Membership Agreement, to unilaterally change the prices, stocks, campaigns, and services offered for honey varieties, bee products, pastdrops (lozenges), functional herbal teas, and other food products sold on www.erbalgida.com at any time.

1.2. The company guarantees that the member will be able to use these services without interruption, except for technical malfunctions and periodic system maintenance.

1.3. The user agrees not to reverse engineer the site's software and infrastructure, or copy its source code; otherwise, they will be solely responsible for any resulting damages.

1.4. The user acknowledges that the identity, delivery, and contact information provided in the form is accurate; providing false information will be considered a breach of the Membership Agreement and may result in unilateral termination of membership.

1.5. Product Information and Health Guarantee: Honey, pollen, propolis, royal jelly, pastdrops (throat lozenges), functional herbal teas, extracts, and food supplements offered for sale on our site are produced in accordance with the Turkish Food Codex regulations; they are in no way prescription drugs. The product descriptions on the site do not claim to treat any disease. The user acknowledges and declares in this Membership Agreement that they place orders considering their own health condition and allergen sensitivities.

1.6. The user agrees not to produce content that violates the law in their reviews and posts on the site; otherwise, their account may be permanently closed in accordance with the terms of the Membership Agreement.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

2.1. The Erbal Gıda name, brands, product designs, logos, photographs, and texts on this site are protected under applicable intellectual property law.

2.2. No visual or written content on the site may be copied or used for commercial purposes without the written permission of the Company; any contrary actions constitute a breach of the Membership Agreement.

3. PRIVACY AND PROTECTION OF PERSONAL DATA (KVKK)

3.1. The company processes and protects the personal data transmitted by the member in accordance with the legislation numbered 6698 on the Protection of Personal Data and the terms of the approved Membership Agreement for the purpose of preparing, invoicing and delivering the order.

3.2. The member may agree to receive campaign and informational messages within the scope of the communication consents given; they may withdraw their consent at any time through the Membership Agreement communication channels.

3.3. Personal data will not be shared with unauthorized third parties except for authorized judicial authorities. Credit card information is transmitted directly to the licensed payment infrastructure without being stored in the system.

4. ACCOUNT SECURITY AND PASSWORD RESPONSIBILITY

The user is solely responsible for maintaining the security of the password they choose to access the site. The Company cannot be held liable under this Membership Agreement for any security breaches that may arise from the use of the password by third parties.

5. FORCE MAJEURE

In the event of unforeseen circumstances such as natural disasters, fires, or infrastructure/internet outages, the obligations of the parties are suspended.

6. CONTRACT AMENDMENTS AND EFFECTIVENESS

The company reserves the right to change the terms and conditions in accordance with regulatory requirements. The updated Membership Agreement is binding on all users from the moment it is published on the site.

7. EVIDENCE AGREEMENT

In the event of any disputes arising between the parties, the Company's commercial ledgers, log records, and system printouts shall constitute conclusive evidence under the Code of Civil Procedure pursuant to this Membership Agreement.

8. COMPETENT COURT AND RESOLUTION OF DISPUTES

The Courts and Enforcement Offices of ERZURUM (Central) shall have exclusive jurisdiction in resolving any legal disputes arising from the application of the provisions of this Membership Agreement. By completing the membership steps, the user is deemed to have accepted all the terms of this Membership Agreement.
