1. PARTIES

This Distance Selling Agreement is concluded between the BUYER, who places an order electronically via the website www.erbalgida.com, and the SELLER, whose details are provided below.

BUYER INFORMATION:

The BUYER is the natural or legal person who enters delivery and billing information and makes payment when placing an order through the www.erbalgida.com website. The BUYER acknowledges that they agree to the terms of this Distance Sales Agreement during the ordering process.

2. DEFINITIONS

In this Distance Selling Agreement;

MINISTRY: The Ministry of Trade,

LAW: Law No. 6502 on Consumer Protection,

REGULATION: The Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188),

SELLER: Erbal Gıda, a company that supplies goods within the scope of its commercial activities,

BUYER: A consumer who acquires a good or service for non-commercial purposes.

AGREEMENT: This Distance Sales Agreement is the text of the agreement concluded between the parties.

PRODUCT / GOODS: Refers to honey, pollen, fresh pure royal jelly, propolis, pastdrops (throat lozenges), functional herbal teas, extracts, and food supplements that are the subject of the order.

3. SUBJECT OF THE AGREEMENT

This Distance Sales Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of products ordered by the BUYER electronically through the SELLER's website. The prices advertised on the site are valid until updated in accordance with the provisions of this Distance Sales Agreement.

4. SUBJECT OF THE AGREEMENT: PRODUCT, PAYMENT AND DELIVERY TERMS

4.1. The type, quantity, content, number of products, and the sales price including taxes are stated in the Distance Sales Agreement order summary and invoice approved by the BUYER.

4.2. Shipping costs are paid by the BUYER in accordance with the Distance Selling Agreement, unless there is a free shipping campaign on the site.

4.3. Payments are made via card using the 3D Secure secure infrastructure offered on the site, or via bank transfer/EFT to the SELLER's bank accounts, under the guarantee of the Distance Sales Agreement.

5. GENERAL TERMS AND CONDITIONS AND SPECIAL DELIVERY RULES

5.1. The BUYER declares in this Distance Sales Agreement that they have read and approved the basic characteristics of the products on the site, the Turkish Food Codex standards, the sales price, and the delivery terms.

5.2. The products subject to this contract will be delivered to the BUYER's address within the legal period of 30 days, in accordance with the terms of the Distance Sales Agreement.

5.3. Obligation to Inspect and Report Damage During Shipping: The BUYER is obligated to inspect the shipping packaging upon receipt of honey, bee products, glass jars, pastdrops, and liquid products. If breakage, crushing, leakage, or spillage is detected on the package, the BUYER must not accept the product and must immediately have the shipping personnel prepare a "Damage Assessment Report." The SELLER cannot be held responsible for damages occurring at the time of delivery to packages received without a report; this is essential within the framework of the Distance Sales Agreement.

5.4. Cold Chain and Temperature-Sensitive Products: Cold chain products such as fresh royal jelly and fresh pollen are shipped in insulated packaging with ice packs. The BUYER is obligated to receive the shipment on the first delivery day and place it in the refrigerator/freezer under the conditions indicated on the packaging to prevent spoilage. In accordance with the Distance Selling Agreement, no refunds will be issued for products whose cold chain has been broken due to late delivery.

5.5. Health Declaration Guarantee: The honey, pastdrops, functional herbal teas, and bee products on this site are not medicinal products but food products produced in accordance with the Turkish Food Codex; they are in no way intended for treatment or prevention. The BUYER acknowledges that they have placed their order with this understanding under the Distance Sales Agreement.

5.6. In the event of delivery disruption due to force majeure, the BUYER will be informed in accordance with the Distance Sales Agreement, and in case of order cancellation, the payment will be refunded within 14 days.

6. RIGHT OF WITHDRAWAL

6.1. The BUYER may exercise their right to withdraw from this Distance Sales Agreement within 14 days of the delivery date of the purchased goods, without incurring any penalty.

6.2. In order to exercise the right of withdrawal, notification must be given to the SELLER within the 14-day legal period, and the product must not fall within the exceptions of the Distance Sales Agreement.

6.3. Products to be returned must be sent with their invoice, original box, and security seals undamaged, in accordance with the rules of the Distance Selling Agreement, via the contracted courier service.

6.4. The SELLER shall refund the product price to the BUYER within 14 days of receiving the product in good condition, in accordance with this Distance Sales Agreement.

7. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED (EXCEPT FOR FOOD AND BEE PRODUCTS)

In accordance with Law No. 6502 and the provisions of the approved Distance Selling Agreement, the right of withdrawal and return cannot be exercised for the following goods:

a) Apitherapy blends and foods prepared according to the consumer's specific requests are exempt from the Distance Selling Agreement.

b) Perishable goods or goods that may expire (such as fresh pure royal jelly, fresh pollen, and other sensitive products requiring a cold chain) cannot be returned under the Distance Selling Agreement.

c) Goods whose protective packaging, security seal, tape, or jar lid has been opened after delivery, and which are therefore unsuitable for return for health and hygiene reasons (such as opened jars of honey, propolis sprays, pastdrops/throat lozenges, functional herbal teas, extracts, and food supplements), cannot be returned under the Distance Selling Agreement.

c) Products that were shipped using a cold chain but spoiled due to not being kept refrigerated cannot be considered under the Distance Selling Agreement.

d) Products that become mixed with other products after delivery and are inherently impossible to separate.

8. DEFAULT AND ITS LEGAL CONSEQUENCES

In the event of the BUYER defaulting on card transactions, the terms of the bank agreement and the applicable Distance Sales Agreement shall apply.

9. COMPETENT COURT AND RESOLUTION OF DISPUTES

In case of disputes arising from this Distance Sales Agreement, complaints may be made to the Provincial and District Consumer Arbitration Boards and Consumer Courts in the BUYER's place of residence, within the legal monetary limits. In commercial disputes, the Courts and Enforcement Offices of ERZURUM (Central) are authorized in accordance with this Distance Sales Agreement.

10. EFFECTIVE DATE

By completing the payment for the order placed through the Site, the BUYER is deemed to have accepted all the terms and conditions of this Distance Sales Agreement.
